1. Acceptance of Terms

By using IsItAGoodCar ("the Service"), you agree to these Terms of Service, our Privacy Policy, and our Cookie Policy. If you don't agree, please don't use the Service.

Nothing in these terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Description of Service

IsItAGoodCar provides vehicle history and specification information for UK-registered vehicles. Data comes from official UK government databases (DVLA, DVSA) and licensed third-party providers (including Experian). We offer both free basic checks and premium paid reports.

We aim to provide accurate information, but we rely on third-party data sources and can't guarantee completeness or real-time accuracy. Official records can contain errors or delays.

3. User Accounts

To access certain features, you may need to create an account. You're responsible for keeping your account credentials confidential and for all activity under your account. Tell us straight away if someone else uses your account without permission.

4. Use of Data and Content

The information provided through the Service is for your personal, non-commercial use only. You may not:

• Use the Service for any commercial purpose or for the benefit of any third party.
• Scrape, crawl, or otherwise use automated means to extract data from the Service.
• Redistribute, sell, or sublicense any data obtained through the Service.
• Use the Service in any way that breaks applicable laws or regulations.

5. Premium Reports, Credits, and Billing

We offer paid features through recurring subscriptions ("Memberships"), one-off credit packs, and individual report purchases. Full AI analysis reports (such as Valuations and MOT Preparation) require credits to unlock.

Payment processing and billing are handled by Stripe. By purchasing, you authorise Stripe to charge your selected payment method. We receive confirmation of your transaction and update your account accordingly.

One-off Reports: Purchased reports are available for 180 days from the date of purchase.

Credit Packs: Purchased credits don't expire as long as your account stays active. If your account is inactive for more than 24 months, we reserve the right to expire unused credits.

6. Experian Data Guarantee

Our Full Premium Vehicle Checks are powered by data licensed from Experian. Where applicable, report sections are marked with "Data provided by Experian".

Every Full Premium Vehicle Check includes an Experian Data Guarantee (up to the guarantee tier amount selected at checkout, e.g. £20,000). This guarantee is underwritten by Experian to protect vehicle buyers against direct financial loss resulting from inaccuracies in recorded Experian data (such as undisclosed finance or unrecorded write-offs), subject to the Experian Data Guarantee Terms and Conditions.

Important: The Experian Data Guarantee applies exclusively to Full Premium Vehicle Checks and covers buyer losses under Experian's terms. It does not apply to Digital Service History checks (which are sourced from manufacturer OE records) or to free basic checks.

7. Immediate Performance, Refunds, and Cancellation Rights

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers typically have a 14-day statutory right to cancel distance contracts. However, for instant digital content and automated data searches:

• Express Consent to Immediate Performance: When purchasing a Full Premium Vehicle Check or a Digital Service History check, you expressly request and consent to the immediate performance of the search and the immediate supply of digital content.
• Waiver of Statutory Cancellation Rights: In accordance with Regulation 37 of the Consumer Contracts Regulations 2013, you explicitly acknowledge that your 14-day right to cancel is completely lost once the third-party database search is executed and the report is delivered on screen or via email.
• Non-Refundable Search Fees: Because third-party database and registry costs (including Experian and manufacturer OE database queries) are paid and incurred immediately on your behalf upon order placement, completed vehicle checks cannot be undone, cancelled, or refunded.
• Credit Packs & Subscriptions: If you purchase a one-off credit pack or membership and have not used any credits or generated any reports, you may request a full refund within 14 days of purchase by contacting support.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

While we do our best to be accurate, we don't guarantee that the information provided is 100% accurate, complete, or up-to-date. Vehicle data depends on records maintained by official government agencies and third-party providers. AI-generated insights are for informational purposes only and shouldn't be taken as professional advice. We exclude liability for errors or omissions in data provided by third parties.

9. Limitation of Liability

To the maximum extent permitted by law, Matter Logic Limited won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim won't exceed the amount you've paid to us in the 12 months before the claim.

10. Modifications to Terms

We may update these Terms of Service at any time. We'll notify you of any material changes by posting the updated terms on this page. Your continued use of the Service after changes are posted means you accept the new terms.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these terms are subject to the exclusive jurisdiction of the courts of England and Wales.
